I was hit by a metro park gate while driving my fiance's car which is insured under his name. I am not insured uner his policy, so therefor "dont have insureance" will the insurance company still pay because its insured? or will be stuck because i have no insurance?


You should be alright as long as your fiance notifies the insurance agency that you will be driving his car and he allows it. The car's insurance (the car owner's insurance) is primary over the driver's insurance, in the case of borrowing cars.

Yes, you will be covered. However- if your going to be driving it around ever again.. you need to be added to his policy. They are going to be awfully suspicious if this happens again and your not..

As long as your fiance tells the insurance company that he gave you permission to drive his car then they will cover it over the deductible. Also, the car is insured so failing all else your fiance can make a claim.However, when I had a similar situation while driving my fiance (now wife's) car the accident was included in my personal driving record for insurance purposes. I did have my own insurance at the time for my truck but my insurance did not have to cover it. Now when I went to get a combined policy after we got married a few years later the accident showed up on my record and they charged me a very slightly higher rate.

BTW if the gate hit your car because of some sort of malfunction then you or your insurance needs to contact the parking lot owner and try to get them to fix it.

Most companies cover any accident involving the insured car, as long as the driver: a) had permission to drive the car b) not listed as "excluded" on the policy c) was not using the car for business purposes.

*There are a select few companies that only insure the named drivers on the policy. Your fiance should check his policy to find out.
